TO CANCEL, EMAIL SUPPORT@MAAGAL.LOVE, CALL +972 53-565-7480, USE THE APP, OR MAIL OR DELIVER A SIGNED AND DATED NOTICE STATING THAT YOU ARE CANCELING THIS AGREEMENT, OR WORDS OF SIMILAR EFFECT, TO: MAAGAL, P.O. BOX 34021, JERUSALEM 9546105, ISRAEL. WE WILL REFUND ALL MONEY PAID FOR THAT SUBSCRIPTION WITHIN 10 DAYS OF RECEIVING YOUR NOTICE. YOUR OTHER CANCELLATION AND REFUND RIGHTS ARE IN §13.10.
Important Notice: MAAGAL™ is currently under early-stage development. Features, functionality, pricing and these Terms may change as the Service evolves. Please be aware that at the current development stage, interruptions in Service and malfunctions in the software may occur, and the storage and retention of your content and images may be affected.
Welcome to MAAGAL™! The Terms of Use set out below together with the MAAGAL™ privacy policy (collectively: the “Terms”) govern your use of the MAAGAL™ mobile application ("App") and all related services (collectively, the "Service") operated by Noa Shirli Fredman, a sole proprietor (Osek Patur) registered in Israel, trading as MAAGAL™. Any reference in the Terms to "we," "us," or "our" refers to MAAGAL™. Any reference in the Terms to “you” or “your” refers to you, and the term “user” refers to you and may refer also to each of the other users of the Service depending on the context. You acknowledge and agree that the users of this Service may include persons who are matchmakers interested in facilitating matches as well as persons interested in finding their match.
By creating an account or using the Service, you agree to be bound by all of the Terms. IF YOU DO NOT AGREE TO BE BOUND BY ALL OF THE TERMS, DO NOT CREATE AN ACCOUNT AND DO NOT USE THE SERVICE.
You are not authorized to create an account or use the Service unless all of the eligibility requirements set out below and in other sections of these Terms are met. By creating an account or using the Service, you represent and warrant that for the entire period of your use of the Service:
4. You have not been convicted of, or pled no contest to, any crime involving violence, threats of violence, or sexual misconduct;
6. You have not previously been removed from the Service by us, unless you have our express written permission to create a new account; 7. You use the Service for personal, non-commercial purposes only, and you will not charge or accept any fee or other benefit for introductions made through the Service; 8. You undertake to be bound by all of the provisions of the Terms and to fulfill all your obligations set out therein; and 9. You reside in a country where the Service is offered — currently the United States, Canada, Australia and Israel — and you are not located in a country that is subject to a U.S. government embargo or that has been designated by the U.S. government as a "terrorist supporting" country, and you are not on any U.S. government list of prohibited or restricted parties.
If at any time you cease to meet any of the eligibility requirements: a) you undertake to immediately notify us in writing of such; and b) all authorization for you to access the Service is automatically revoked without notice to you, and you must immediately delete your account. We retain the right to remove your access without warning.
While we may require age verification at any time and may use third-party age verification services to confirm your eligibility, the responsibility falls solely on you to accurately provide your age and to meet all of the eligibility requirements throughout the period in which you use the Service.
Identity verification. We may require users to complete identity verification (such as a liveness check or government-issued ID document verification) during signup or in specific contexts (for example, when an account is reported, to obtain a verified status badge, or to access certain features). When identity verification is enabled, explicit affirmative consent will be requested at the time of verification.
Profile photos must clearly show your face. Photos that fail our automated content review (nudity, violence, drugs, hate symbols, or other policy violations) will be rejected. You may appeal an automated rejection by contacting support@maagal.love within 30 days; after that period, rejected content is permanently deleted.
To use the Service, you must create an account by providing a valid email address and phone number of yours, and completing the onboarding profile. You agree to:
YOU MAY NOT CREATE MULTIPLE ACCOUNTS, USE ANOTHER PERSON'S ACCOUNT OR TRANSFER YOUR ACCOUNT OR USE OF YOUR ACCOUNT TO ANYONE ELSE. YOUR ACCOUNT IS NON-TRANSFERABLE AND NON-ASSIGNABLE TO ANY PERSON OR ENTITY UNDER ANY CIRCUMSTANCES, UNLESS OTHERWISE REQUIRED BY APPLICABLE LAW.
MAAGAL is a social matchmaking platform where connections are made through networking circles. MAAGAL aims to foster genuine, trust-based connections. The Service relies on real social relationships — you are expected to know and trust the people in your circle.
MAAGAL is tailored for orthodox / traditional Jewish singles seeking meaningful relationships within their community. The Service's features, matching criteria, and user experience focus on the values and traditions of this community. This focus is not intended to express judgment toward, exclude, or offend any person of any ethnicity, race, religion, sexual orientation, or gender identity. All users who meet our eligibility requirements and agree to these Terms are welcome to use the Service. Matching preferences — including religion and the gender you wish to meet — are chosen by each user.
Subject to the terms and conditions of the Terms, MAAGAL grants you a limited, non-exclusive, non-transferable, non-assignable right to access and use the Service solely for your own non-commercial purposes directly connected to social matchmaking, and not for the benefit or use of any other person or entity. Immediately upon termination or suspension of your account (whether initiated by you or by MAAGAL), this license granted to you automatically ends without the provision of any notice.
We reserve the right to add, modify, or remove any features of the Service at any time, without notice. This includes changes to free and premium features, matching algorithms, communication tools, and any other functionality, and such changes may be mandatory. Changes to paid features are subject to §13.4 and to the rights of consumers set out in §13.10–§13.13. If you do not wish to engage with a mandatory feature, you can ask us to terminate your account.
You agree to use the Service in a respectful and lawful manner. You must not:
We reserve the right to investigate and take action against violations, including temporary suspension or permanent termination of your account, all at our sole discretion and without notice, and without mitigating your liability in this regard. The license granted to you under the Terms is automatically revoked if you violate any of the above.
MAAGAL prohibits uploading or sharing any content that:
2. Is abusive, insulting, threatening, discriminatory, or promotes racism, sexism, hatred, antisemitism or bigotry; 3. Is illegal or encourages illegal activity, including terrorism, human trafficking, or incitement of violence; 4. Encourages or facilitates activity that may result in harm, including self-harm, eating disorders, or dangerous challenges;
6. Relates to commercial activities (sales, promotions, advertising, solicitation for services);
8. Infringes upon any third party's rights (including intellectual property and privacy rights); 9. Was not written or created by you, or was automatically generated by AI, unless you receive MAAGAL's prior express written consent;
Uploading Prohibited Content may result in immediate suspension or termination of your account. The license granted to you under these Terms is automatically revoked if you violate any of the above.
MAAGAL aims to maintain a safe and respectful environment. We aim to monitor and moderate user-generated content, including but not limited to text, images, profile information, and chat messages, to detect and remove inappropriate, harmful, or policy-violating content.
To carry out content monitoring, we may use:
You understand and agree that we may analyze, access, store and duplicate your content, including messages and other communications, to monitor it for compliance with these Terms, to investigate reports, and to operate the Service, including through automated technologies, in accordance with mandatory applicable law and as described in our Privacy Policy. We do not use your private messages to suggest matches, and we do not use your content or personal information to train artificial intelligence models. By using the Service, you acknowledge and consent to the use of automated tools and third-party services for content monitoring purposes.
Any content that violates these Terms may be removed without notice. We may remove, delete, edit, limit, or block access to any of your content at any time at our sole discretion. A repeated or severe violation of the Term’s content policies may result in your account being suspended or terminated without notice, and your license immediately revoked. Nothing set out above or in any other section of these Terms is intended, or should be interpreted, to place an obligation on MAAGAL to review or to monitor your content, and you are solely responsible for the content that you upload.
You retain ownership of the content that you upload (photos, text, messages), and are solely responsible to ensure that any content that you upload is not prohibited content under these Terms and does not violate the intellectual property rights of any person or entity. By uploading content to MAAGAL, you grant us a worldwide, royalty-free, non-exclusive license, sub-licensable only to the service providers that operate the Service for us, to host, store, use, copy, display, reproduce, adapt (for example, resize or compress), and distribute your content solely for operating the Service and for legal and regulatory purposes. This license ends when you delete the content or your account, except for copies kept for the periods described in our Privacy Policy (for example, backups, safety records and records of phone number exchanges), for as long as they are kept.
You authorize MAAGAL, at MAAGAL’s sole discretion to act on your behalf, with respect to infringing uses of your content taken from the Service by other users or third parties.
You are solely responsible for ensuring that your content does not violate these Terms or any applicable laws. We may remove, delete, edit, limit, or block access to any of your content at any time at our sole discretion. MAAGAL has no obligation to display or review your content.
By submitting suggestions or feedback to MAAGAL regarding the Service, you agree that MAAGAL may use and share such feedback for any purpose without compensating you.

Photos may, at our discretion, be subject to automated and manual monitoring. We reserve the right to remove photos that violate these requirements.
You can report users who violate these Terms or make you feel unsafe or uncomfortable. In the process of reporting, it is required that you provide details to explain and substantiate the violation. You can also block users to prevent further contact. We take reports seriously and will make reasonable efforts to investigate.
Be aware that false or malicious reporting may result in enforcement actions against the reporting account, including suspension or permanent ban and revocation of the use license. In assessing misuse, we consider factors such as evidence that a report was motivated by bias, hatred, or other malicious intent.
MAAGAL deploys commercially reasonable security precautions intended to protect against unauthorized access to content you submit and data stored in connection with your use of the Service. We make commercially reasonable efforts to deploy corrections for security vulnerabilities made known to us.

You acknowledge that, notwithstanding the security precautions deployed by MAAGAL, the use of or connection to the Internet provides the opportunity for unauthorized third parties to circumvent such precautions and illegally gain access to the Service and your content. MAAGAL DOES NOT GUARANTEE THE PRIVACY, SECURITY, INTEGRITY, OR AUTHENTICITY OF ANY INFORMATION TRANSMITTED OVER OR STORED IN ANY SYSTEM CONNECTED TO OR ACCESSIBLE VIA THE INTERNET. YOUR USE OF THE SERVICE VIA THE INTERNET IS SOLELY AT YOUR OWN RISK.
MAAGAL IS A PLATFORM AND NOT A MATCHMAKER. MAAGAL DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS OR ANY OTHER BACKGROUND SCREENING OF ITS USERS. EXCEPT FOR THE IDENTITY VERIFICATION DESCRIBED IN SECTION 1, WHERE IT IS ENABLED, MAAGAL DOES NOT VERIFY THE IDENTITY OF ITS USERS BEYOND PHONE AND EMAIL CONFIRMATION. WE DO NOT UNDERTAKE TO VERIFY THE ACCURACY OF USER-PROVIDED INFORMATION, INCLUDING BUT NOT LIMITED TO NAME, AGE, PHOTOS, MARITAL STATUS, OR ANY OTHER PROFILE DETAILS. MAAGAL MAKES NO REPRESENTATIONS OR WARRANTIES AS TO THE CONDUCT, IDENTITY, HEALTH, INTENTIONS, LEGITIMACY, TRUSTWORTHINESS OR VERACITY OF USERS.
YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER USERS.
By using the Service, you acknowledge and agree that:
MAAGAL DOES NOT CONDUCT CRIMINAL BACKGROUND SCREENINGS OF ITS MEMBERS.
MAAGAL ALSO DOES NOT CHECK THE IDENTITY OF ITS MEMBERS, OTHER THAN CONFIRMING A PHONE NUMBER AND AN EMAIL ADDRESS (AND IDENTITY VERIFICATION WHERE IT IS ENABLED, AS DESCRIBED IN SECTION 1).

The Service has a mutual phone number exchange feature within match chats. By initiating or accepting a number exchange request, you:
You may decline any number exchange request without penalty. If you experience harassment or misuse of your phone number by another user, please report them through the App and take your own independent action to curtail such harassment or misuse.
MAAGAL offers premium features through paid subscriptions ("Premium"). If you purchase a Premium subscription:
MAAGAL may offer multiple subscription tiers with different pricing and features, and over time, at MAAGAL’s sole discretion, modify, remove or supplement the features of each tier. Current tiers include:
The specific usage caps per feature for each tier are displayed in the App and may be adjusted from time to time without notice.
During certain launch or promotional periods, MAAGAL may offer promotional pricing at a rate lower than the standard subscription price. If you subscribe at a promotional rate:
WE RESERVE THE RIGHT TO CHANGE SUBSCRIPTION PRICING. Price changes:
MAAGAL may offer an in-app virtual currency ("Coins") that can be purchased and used within the Service:
You may purchase Coins as gifts for other users of the Service. Gifted Coins:
During the initial launch period, a limited number of "Founder" subscriptions may be available at a special rate and with exclusive features. Founder subscriptions:
All purchases are final and nonrefundable, except as required by any mandatory applicable law, and except as set out in §13.10 below. Purchases are made through Apple or Google, so refunds that the law or these Terms require are requested through them: from Apple at reportaproblem.apple.com, and from Google Play through your Google Play order history. If a store does not process a refund that you are entitled to, contact us at support@maagal.love and we will help.
Nothing in these Terms excludes, restricts or modifies any right or remedy that you have under consumer protection law that cannot lawfully be excluded, including, if you are in Australia, the consumer guarantees under the Australian Consumer Law, and, if you are in Israel, your rights under the Israeli Consumer Protection Law, 5741-1981.
If MAAGAL, at its sole discretion, offers a free trial period:
The right to cancel within four business days of subscribing is set out at the top of these Terms.
If you die or become disabled before your paid period ends, you or your estate may cancel, and we will refund the part of the payment allocable to the period after the death or the onset of the disability within 30 days of notice. "Disabled" means a condition, verified in writing by a physician you choose, that prevents you from using the Service; if the physician expects the disability to last less than six months, we may instead extend your subscription by six months at no charge. If you move your residence 20 miles or more and no longer wish to use the Service, you may cancel and receive a refund of the unused part of your payment.
Where possible, refunds are made through Apple or Google. If a store does not refund you an amount due under this section, we will refund you directly. On request, we will send you a copy of these Terms as a PDF.
If you are a consumer in Israel:
If you are a consumer in Quebec, §21.2 and the exclusive-jurisdiction provisions of §21 and §25 do not apply to you: you may bring a claim in the courts of Quebec, individually or as a member of a class, and Quebec's mandatory law applies. You may cancel a subscription at any time and are entitled to any refund the Consumer Protection Act (Quebec) provides. Before a free trial or a promotional price ends, we will tell you, between 2 and 10 days in advance, the price that will apply and how to cancel. Any provision of these Terms that the Consumer Protection Act prohibits does not apply to you.
If you are a consumer in Australia:
MAAGAL uses artificial intelligence and automated systems to process your profile information for match suggestions and compatibility scoring. Matchmaking is the core purpose of the Service, so this runs for every member who is open to matching — which requires your separate consent to sensitive information — and has no separate on/off setting. You choose what information to provide for it, and you may edit or clear your matching answers at any time, as described in our Privacy Policy.
MAAGAL may also, at its sole discretion, use artificial intelligence and automated systems to:
This processing may involve third-party AI and automated services and technologies. By using the Service, you consent to said processing as further described in our Privacy Policy. If you do not consent, you may delete your account at any time.
You have the right to request human review of any significant automated decision that affects your account. Contact us, in a timely manner, at the email address listed further below to make such a request. To avoid any misunderstanding, nothing contained in this section shall operate to reduce the obligations of the user to comply with the Terms or to affect the liability of MAAGAL in such regard.
Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy, which is incorporated into the Terms by reference. By using the Service, you consent to all of the terms and practices described in the Privacy Policy, subject to any mandatory applicable law.
As between you and MAAGAL, the Service, including, without limitation, the App, design, features, code, and branding related to the Service, is owned by MAAGAL and is entitled to intellectual property protections. During the term of your account and for an unlimited time thereafter, you may not copy, duplicate, transfer, modify, distribute, sell, reverse-engineer or decompile or otherwise disassemble the Service or any of its components (in whole or in part).
If you believe that any aspect of any content or use of the Service infringes intellectual property rights, please contact us at support@maagal.love with a detailed description of the infringement and we will make reasonable efforts to investigate. For copyright, see §29.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OR REPRESENTATIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITH RESPECT TO QUALITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE OR BUG-FREE.
IN ADDITION WE DO NOT REPRESENT OR WARRANT THAT:
MAAGAL ASSUMES NO RESPONSIBILITY FOR ANY CONTENT THAT YOU OR ANOTHER USER POSTS, SENDS, OR RECEIVES THROUGH THE SERVICE, NOR FOR THE IDENTITY, INTENTIONS, LEGITIMACY, OR VERACITY OF ANY USER.
YOU MUST USE THE SERVICE SOLELY AT YOUR OWN RISK.
THE AFORESAID IS SUBJECT TO ANY MANDATORY REQUIREMENTS OF APPLICABLE LAW.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MAAGAL SHALL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, PUNITIVE, OR PHYSICAL OR ENHANCED DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, LOSS OF DATA, EMOTIONAL DISTRESS, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING FROM: (I) YOUR ACCESS TO OR USE OF THE SERVICE; (II) SERVICE INTERRUPTION, SUSPENSION, TERMINATION OR CANCELLATION; (III) THE CONDUCT OR CONTENT OR COMMUNICATIONS OF ANY USERS ON OR THROUGH THE SERVICE; OR (IV) ANY UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT OR COMMUNICATIONS, EVEN IF MAAGAL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
SUBJECT TO THE FOREGOING LIABILITY LIMITATIONS, OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT PAID, IF ANY, BY YOU TO MAAGAL FOR THE SERVICE DURING THE TWELVE (12) MONTH PERIOD PRECEDING THE CLAIM.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF ANY SUCH JURISDICTIONS ARE APPLICABLE, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.
YOU AGREE, TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, TO INDEMNIFY, DEFEND, AND HOLD HARMLESS MAAGAL, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, CONSULTANTS AND THIRD-PARTY PROVIDERS FROM ANY CLAIMS, PROCEEDINGS, DAMAGES, LOSSES, OR EXPENSES (INCLUDING REASONABLE LEGAL FEES AND COURT COSTS) ARISING FROM:
We may, at our sole discretion and without notice, suspend (temporarily restrict access) or terminate (permanently disable) your account if we reasonably believe that you have:
Suspension may be temporary or indefinite, depending on the severity of the violation. While we may notify you of the general reason for suspension, such notification will be general and not provide details. You understand and agree that we may not share or disclose information regarding your account termination if, to our understanding, doing so would potentially impair the safety or privacy of other users or violate any legal requirement or contractual undertaking.
You may delete your account at any time through the App settings.
Upon termination:
Fraud bans: if we ban an account because we believe it used a false identity or sought money by fraud, we will notify the members who exchanged messages with it, identify that account, warn them not to send it money, and point them to information about avoiding online fraud.
Ban enforcement: If your account is permanently banned, we may retain certain identifying information (such as hashed phone number, hashed email address, and — only if identity verification was enabled for your account and you consented to it — facial recognition data) to prevent re-registration. This data will be used for the purpose of enforcing the ban. See our Privacy Policy for details.
To the extent permitted by applicable law, before filing any formal legal action, you agree to first contact us at support@maagal.love and attempt to resolve the dispute informally for at least 60 days. Many disputes can be resolved without litigation. Any limitation period is paused during those 60 days.
If you live in the United States, the Federal Arbitration Act governs this section. YOU AND MAAGAL GIVE UP THE RIGHT TO SUE IN COURT AND THE RIGHT TO A JURY TRIAL. Any claim relating to these Terms or the Service that is not resolved informally will be resolved by individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, held by video or in the county where you live. We will pay all AAA and arbitrator fees beyond the consumer filing fee. The arbitration is not confidential. YOU AND MAAGAL MAY BRING CLAIMS AGAINST EACH OTHER ONLY ON AN INDIVIDUAL BASIS, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. A claim for public injunctive relief will be decided by a court after the arbitration. If the class waiver is found unenforceable for a claim, that claim proceeds in court, not in arbitration.
If you live outside the United States, these Terms do not require arbitration and do not waive your right to bring or join a class action. You may bring a claim in the courts where you live: if you are a consumer in Israel, in any competent Israeli court, individually or as a class action under the Class Actions Law, 5766-2006; and see §13.12 for Quebec and §13.13 for Australia.
Either party may bring an individual claim in a small claims court that has jurisdiction over it, and either party may ask a court for injunctive or other equitable relief to prevent the actual or threatened infringement of intellectual property rights.
YOU MAY OPT OUT OF §21.2 BY SENDING WRITTEN NOTICE TO SUPPORT@maagal.love WITHIN 30 DAYS OF FIRST ACCEPTING THESE TERMS, OR ANY VERSION OF THEM THAT CHANGES §21.2. IF YOU OPT OUT, YOUR CLAIMS ARE DECIDED IN COURT UNDER §25.
If you are using a pre-release or beta version of the Service, you acknowledge that the Service is in an early development stage and that:
Your participation in any beta program entitles you only to access the Beta version, and not to any continued access beyond the Beta program in which you are participating.
MAAGAL SHALL NOT BE LIABLE FOR ANY FAILURE OR DELAY IN PERFORMING ITS OBLIGATIONS UNDER THESE TERMS, OR TO ANY DAMAGES OR LOSS INCURRED, DUE TO CAUSES BEYOND ITS REASONABLE CONTROL, INCLUDING BUT NOT LIMITED TO: NATURAL DISASTERS, ACTS OF GOVERNMENT OR REGULATORS, PANDEMICS, WAR, TERRORISM, RIOTS, INTERNET OR TELECOMMUNICATIONS FAILURES, POWER OUTAGES, FIRE, OR ACTIONS BY THIRD-PARTY PROVIDERS AND SELLERS (INCLUDING HOSTING, INTERNET AND INFRASTRUCTURE PROVIDERS AND APP SUBSCRIPTION SELLERS).
We may update these Terms from time to time. When we make changes, we will update the date at the top of these Terms. When we make a material change, we will notify you in the App before it takes effect and ask you to accept the updated Terms before you continue to use the Service; changes to pricing are also subject to §13.4. Other changes take effect when they are published, and your continued use of the Service after that constitutes acceptance of them.
If you do not agree to the updated Terms, you should stop using the Service and delete your account. A change does not apply to a dispute that arose before the change was published.
These Terms are governed by the laws of the State of Israel, without regard to conflict of law principles, except that §21.2 is governed by the Federal Arbitration Act. If you live in the United States, Canada or Australia, the law of the place where you live also applies to any right it does not allow you to waive, and any court proceeding takes place where you live. Otherwise, and subject to §21, disputes are resolved in the courts of Jerusalem, Israel.
Nothing set out in the Terms is intended to conflict with any mandatory applicable law, including, without limitation, any mandatory consumer protection provisions applicable in your case, and nothing in these Terms affects your rights under such provisions that are mandatory and not subject to waiver.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
These Terms, including without limitation the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and MAAGAL regarding the Service and supersede all prior agreements and understandings.
No agency, partnership, joint venture, fiduciary, or other special relationship or employment is created as a result of these Terms, and you may not make any representations on behalf of or bind MAAGAL in any manner. For the avoidance of doubt, MAAGAL has no obligations and no liability with respect to any actions or omissions of third-party providers involved with your App subscription and receipt of the Service, and such third-party providers act independently and are not an agent or representative of MAAGAL.
No delay or omission by MAAGAL in enforcing any of its rights or any term of these Terms shall be deemed to constitute a waiver by MAAGAL of any such rights or term.
Any rights and licenses granted hereunder may not be transferred or assigned by you, but may be assigned by us without restriction.

We will remove or disable access to material that we reasonably believe is infringing, and we will terminate, in appropriate circumstances, the accounts of users who repeatedly infringe.
If your content was removed and you believe that was a mistake, you may send a counter-notice to the same agent, including: your physical or electronic signature; identification of the material that was removed and where it appeared; a statement, under penalty of perjury, that you have a good-faith belief that it was removed by mistake or misidentification; your name, address and telephone number; and a statement that you consent to the jurisdiction of the U.S. federal district court for your address (or, if you are outside the United States, any district in which MAAGAL may be found) and will accept service of process from the person who sent the notice. We will forward your counter-notice to that person and restore the material within 10 to 14 business days unless they tell us that they have filed a court action.

You agree to receive communications from us electronically — in the App, by push notification, or by email to the address registered to your account — and agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. We send messages about your account, your matches and these Terms; we do not send you marketing messages unless you have agreed to receive them.
